LAS CRUCES, N.M. - A couple faces a negligent child abuse charge after they left their toddler in the car to have drinks at Applebee's, police said.

Around 1 a.m. Thursday, an employee at the restaurant at 2501 E. Lohman Ave. saw a 2-year-old girl unsupervised and in a child safety seat inside a black Chevrolet Silverado parked at the restaurant, police said.

The investigation revealed that Yacxubelli Grado-Garcia and Ramiro Hernandez went to Applebee's to celebrate Grado-Garcia's birthday.

The couple ordered two 23-ounce mugs of beer, an appetizer and had more beer about 20 minutes later. In total, the couple spent around 50 minutes inside the restaurant, police said.

When police arrived, Grado-Garcia told police their daughter was asleep and they didn't want to wake her, officials said.

The child was turned over to one of Hernandez's siblings, police said.

The 2-year-old didn't show any signs of injury, police said.

Grado-Garcia and Hernandez were charged with one count of negligent child abuse. They were booked into the county jail with bail set at $10,000.
