Dona Ana county clerk pays it forward for couple seeking to marry

EL PASO, Texas - The county clerk that paved the way for same-sex couples in Dona Ana County to get a marriage license announced he will be donating to the New Mexico Unites for Marriage.

Lynn Ellins will be giving $1,307.98 to New Mexico Unites for Marriage.

The donation is the remainder of what was left after paying court fees related a lawsuit that was filed against him by a group of Republican New Mexico legislators, according to Dona Ana County officials.

The group filed the lawsuit against Ellins after he announced on Aug. 21 that his office would issue marriage licenses to same-gender couples.

Ellins sought out donations to pay for the court fees totaling in $31,758.70. In total, Ellins received $33,066.68 in donations.

"We did the right thing at the right time by issuing the licenses last August, and we're doing the right thing now by donating the balance of our legal-defense fund to the coalition that stood beside us while we waited for the Supreme Court to make its determination," Ellins said. "I want to thank all who donated, thereby helping me keep my pledge to the taxpayers of Doa Ana County that I would not use their tax dollars to wage this important fight for equality."
