District attorney wants local judge off Daniel Villegas case

EL PASO, Texas- District Court Judge Sam Medrano ruled more than a year ago that, in his opinion, Daniel Villegas received ineffective counsel when a local jury found him guilty of a double murder.

Last month the Texas Court of Criminal Appeals granted Villegas a new trial.

Today we learned District Attorney Jamie Esparza filed paperwork Monday, asking Medrano to recuse himself from the case.

He argued the judge would not be impartial in Villegas's retrial and ultimately harbors a strong opinion that Villegas is innocent.

Medrano told KFOX 14 that he has no comment.
