Grand jury declines to charge El Paso police officer in deadly jail shooting of Daniel Saenz

EL PASO, Texas -- El Paso Police Chief Greg Allen held a press conference after a grand jury declined to indict a police officer who shot and killed a man in custody.

Allen spoke to the media Wednesday morning about the finding of the deadly shooting on March 8, 2013, but he didn't stick around for any questions afterward.

KFOX14 asked Mayor Oscar Leeser about Allen not taking questions about the shooting.

"I think that I need to talk to him, and see what was going on and hear what happened, but I can't answer for somebody," Leeser said. "I found out about it late this afternoon and to be honest I can't answer for him cause I haven't had an opportunity to speak with him. We should all be accountable to the public."

Allen told the media he was contacted by the district attorney's office Tuesday. "He will not present the case on the second basis."

According to police, Officer Jose Flores shot Daniel Rodrigo Saenz, killing him.

Saenz, who was handcuffed, fought with Flores outside the El Paso County Detention Facility, according to an investigation conducted by the Crimes Against Persons Unit, the Shooting Review Team and the Texas Rangers.

According to police, Flores and a contract employee were taking Saenz for a medical release.

The medical release was needed after Saenz hit his head on a door frame, causing a cut on his head, according to the police release.

Saenz was taken into custody after an early-morning incident at an east-side grocery store and at the hospital.

Allen said during the news conference an administrative investigation is still pending.
