Woman says police fail to protect her from estranged husband

EL PASO, Texas —

A woman contacted KFOX14 alleging that the justice system is failing to keep her safe from her estranged husband.

Out of fear of retaliation, the woman asked us to keep her identity hidden. For that purpose, she will be referred to as "Maria."

Maria told KFOX14 that it all started when her husband assaulted her several years ago. He was put on probation for that crime, and she slapped him with a protective order, but Maria says, he consistently violates that protective order by stalking her, harassing her, and sending her graphic pictures.

She told KFOX14 that every time she has filed a report to police, they tell her she simply needs to get a divorce. She alleges that police have never arrested her husband for violating the terms of the protective order, which mandates that he stay 200 yards away from her at all times.

"I've called EPPD several times, they've actually seen him present at my home, and they never did anything about it, I showed them my protective order, and I feel that they think they're higher than a judge's signature," she said. "I'm very frustrated because nothing has been done, he's broken into my house, stolen my vechile, he now lives in my home which I was forced to move out of for my safety, I moved out and he found me!".


Maria told KFOX14 the recent coverage of Brian Engleton's trial for murdering his wife Deidre Engleton back in 2011 opened her eyes to how dangerous her situation can be. Deidre had a protective order against Brian at the time of her death, and the order was found in her purse next to her body.

Maria has a message for the authorities who she says, are failing to protect herself, and others:

"Follow the protective order as it is, and give us some justice and peace of mind before we end up six feet underground. Follow that protective order. Protect us!" she said.

KFOX14 spoke with Javier Sambrano, a public information officer from the El Paso Police Department. He said that their records indicate that Maria's last complaint was rejected by the District Attorney's office because she went to her husband's residence to pick up some belongings, technically making her the one that sought him out.

Maria response to that was that it used to be her home until she left when her husband kept inviting himself over. "I went to my old home to retrieve the rest of my belongings, I did not know he was there, I automatically called 911, but the D.A. says because I was the one that went over there, they can't do anything about it," she said.

KFOX14 also spoke with Elihu Dominguez, the spokesman for the County Attorney's office. He said that anyone in direct violation of a restraining order should be arrested immediately, and that the only reasons why that wouldn't happen would be because an officer doesn't find enough evidence or probable cause to make an arrest, or the D.A. office decides not to proceed with criminal charges.
