Vinton council members facing removal fail to respond to judge's orders

VINTON, Texas —

Three council members face removal from office by a district court judge, but new documents obtained exclusively by KFOX14 show two are not following the judge's orders.

Two residents filed a petition for removal back in October, and as KFOX14 previously reported, a petition for removal is the only way Vinton can remove elected officials.

Council members Juvencia Rios Ontiveros, Martha Garcia and Maria Medina face being forcibly removed from office from a district court judge.

The three are accused of violating dozens of state, local and federal laws in their roles as council members of the Village of Vinton.

Namely, their efforts to refuse to accept previously awarded grants for badly needed water and sewer, their actions plunged the village into more than a half-million dollar debt and they also refused to pass a 2012-2013 budget.

Monday was an important court date missed by two council members.

When District court judge Stephen Ables issued the lawsuits be served to the council members, he gave them 30 days to make their first appearance in court by a written response with a deadline of March 4.

KFOX14 obtained documents showing Garcia was the only one to enter her court appearance. She submitted a response through her lawyer, Doris Sipes.

In addition, Garcia submitted a counterclaim that those who filed the lawsuit calling for her removal did so in "bad faith" and asks for payment for her attorney fees.

It states Garcia "acted in good faith in all things in regards to her personally as an individual and in her capacity as an alder person for the Village of Vinton."

It also states "Martha Garcia generally denies each and every allegation."

Ontiveros and Medina did not respond to the judge's order by March 4.
