EL PASO, Texas —

A 5-year-old boy was in serious condition Tuesday after a car crash sent his head into a windshield.

The crash happened on Zaragoza Road near the Border Highway. A GMC Sierra pickup was northbound on Zaragoza when he crossed into southbound traffic and smashed into a red Ford Focus, police said.

According to police, the child was not restrained in a child-safety seat and was not in an adult seat belt either.

"The car seat or the booster would probably have limited the injuries in this situation,” said Detective Mike Baranyay, with the El Paso Police Department. "By putting them in that car seat or that booster and making sure that it’s installed properly will limit the potential for injuries."

It is against Texas law not to have children in a proper restraint or seat belt. All infants and toddlers must be in a car seat designed for their age and weight. All children under 8 years old and under four feet 9 inches tall must be secured in a booster seat.

The child in the crash is said to be suffering massive head injuries from the crash.

The driver of the Focus was not restrained either, and is listed in stable condition. There is no word if he will face any charges for failing to restrain the child.
