TABC Investigating fatal car crash

EL PASO,Texas —

It's been one day since police say Miguel Vargas, 22, crashed his car through a wall on North Mesa and down into an embankment, killing two of his passengers. El Paso Police say he was drunk and speeding. His family says it was a terrible accident.

Not so, says the Reyes family.

We spoke with Sergio Reyes and his sister, Estella Reyes,  outside of University Medical Center, where they've been at the bedside of 18-year-old Stacy Reyes. She is Sergio Reyes's daughter and Estella Reyes's niece. Sergio Reyes' other daughter, Idaly Reyes, 18, died in the accident after being trapped in the burning car.

Stacy Reyes is in critical condition with several broken bones all over her body. Her family is praying she will walk again. She was one of four passengers inside of Vargas's car early Wednesday morning when police say he crashed, killing Idaly and Kim Araujo, 23. He's been charged with intoxicated manslaughter in connection to the crash, police say. 

The Reyes family is devastated. They say the crash was no accident. "When I heard these people say, There were no victims here, it was an accident, ' it wasn't.  This guy wasn't focused on what he was doing, and he was  drinking and driving with his girls there, " said Sergio Reyes.

The other passenger, Nefi Armendariz, 20, was just airlifted to Lubbock to be treated for his burns.

Vargas remains behind bars on a $250,000 bond.

 Meanwhile, The Texas Alcoholic Beverage Commision is investigating the accident. They want to know if any of the three undersage passengers were served alcohol the the night of the accident.
