EL PASO, Texas —

Months after a deadly train crash in Anthony, N.M., residents say they still haven't seen more protection at area railroad crossings.

A crash back in July killed 3-year-old Nadeen Tovar Hernandez. Five other family members were seriously injured. The New Mexico State polilce reported that the driver was trying to beat the train, but the family and residents said the crossings should have warning signs.

Residents said they don't know how long they have to wait to get more protection.

"It's very important because if not, imagine, if we were crossing. We're going to get stuck right there. I have five kids, imagine. It would be terrible," said Ana Barreras from Anthony.

Burlington Northern and Santa Fe Railway officials said usually rural areas, like a lot of intersections in Anthony, will only have a sign. Company officials said BNSF does not determine the level of protection -- the municipalities do.

KFOX called newly-elected Anthony Mayor Raymond Gonzalez, but he declined an on-camera interview. But he said the town doesn't have the money to do that at the moment. Residents said, it should be a priority, especially now that this elementary school is open.

"Because it's a school zone and there's a lot of kids, all the parents are dropping off their kids and stuff. It's important to have train signals on," said Aracely Macias from Anthony.

The town is represented by the New Mexico Municipal League. One of their lawyers told KFOX that Anthony is under the threat of a lawsuit because of the latest deadly crash. He couldn't release any other details.
