Arrest Affidavit

LAS CRUCES, N.M. —

A police affidavit for a search warrant reveals details about why an 8-year-old disabled girl was kept reportedly in a cage for hours on a Friday night.

The soon-to-be adopted girl was kept in the homemade wooden cage for hours Friday evening for "her safety," indicated the affidavit.

John Patriarchias is named in the document. A Las Cruces Police Department spokesperson said Patriarchias is the estranged husband of Cindy Patriarchias. Cindy is the woman accused of keeping the girl locked up in the crate for close to three hours Friday evening while her three other kids and live-in boyfriend when to a school-sponsored movie just down the street from their home.

Edmond Gonzales is charged with allowing the child abuse to happen.

Tuesday, KFOX 14 learned that the man who called police, the woman's estranged husband John Patriarchias, said to police he built the cage for the young girl.

The document said that the cage had been built when she was a toddler because she kept getting out of bed and get into household cleaning supplies, medicine bottles and cabinets during the night.

It also states that the wood cage was "built for her safety."

John also told police that the cage was never used for punishment, but he says he returned to this home on five different occasions since the two separated in December 2012 to find the little girl in the crate for misbehaving.

A Las Cruces police spokesperson said that statement, as well as many others, are still under investigation.
