DONA ANA COUNTY, N.M. —

A SWAT situation developed Thursday night near Guamis Road in Las Cruces when a 78-year-old man pointed a gun at his neighbor, according to Kelly Jameson, a spokeswoman for the Dona Ana County Sheriff's Office. 

Around 8 p.m., Exiquio Bustamante went to his neighbor’s home unprovoked and fired shots in the direction of the neighbor and a dog, Jameson said.

He then went inside his home and barricaded himself, Jameson said.

A SWAT negotiator got Bustamante out of his home after an hour.

Witnesses said they saw Bustamante in handcuffs on the ground and it seemed as though he was writhing while he was restrained

Bustamante was arrested and charged with two counts of aggravated assault with a deadly weapon and criminal trespassing.
