Mother accused of killing daughter stays very emotional during first day of new trial

EL PASO, Texas —

Yara Perez spent the day crying and wiping tears from her face.

One of the most difficult moments for everyone in the courtroom Tuesday was when prosecutors showed pictures of Jacqueline Gonzalez, 3, deceased, inside of the trunk of a car. There were countless bruises all over her body. 

The trial originally started in June. Judge Angie Juarez Barill called for a mistrial after one juror overheard a sheriff's deputy, who was acting as a security guard, say, "Perez shouldn't get away with it." 

In November 2007, Gonzalez was found beaten to death and stuffed into a plastic bag in the trunk of, Perez's car. 

Perez's then-boyfriend, Francisco Castaneda, is already serving a life sentence for the girl's death. 

Tuesday, Castaneda's sister, Abigail Castaneda, told the jury about seeing the girl through a door. She said most of Gonzalez's body was covered with a blanket. 

Defense attorney, Joe Spencer, cross examined Joe Ochoa, the crime scene investigator, and tried to make a case that his job was too specific to have all of the information. 

Ochoa was asked, "You wouldn't know if Castaneda was home alone with the child all day, because that was not your job, right?" Ochoa replied, "No". 

The prosecution will continue presenting evidence starting Wednesday at 8:30 am.
