EL PASO, Texas —
A man facing intoxicated manslaughter charges for an accident back in 2009 is found guilty Saturday.
Jurors heard closing arguments and deliberated for several hours before coming back with a verdict in the case of Eric Barajas.
"We're of course disappointed in the verdict but we have to go through the punishment stage," said Stuart Leeds, Barrajas' attorney.
After several hours of deliberation, 36-year-old Eric Barajas was found guilty and charged with two counts of intoxicated manslaughter in the deaths of two pedestrians in 2009.
22-year-old Angela Gonzalez and 26-year-old Orlando Figueroa were hit by a car driven by Barajas they were crossing Lee Trevino.
The victims didn't use a crosswalk and were intoxicated at the time of the accident.
The defense argued the two posed a danger to themselves and others while the prosecution said Barajas was speeding.
"We felt this was a good case to try, we felt there was a serious legal issue of causation in the case but with two dead bodies, there was just too much to overcome," said Leeds.
But deliberations didn't go off without a hitch. A note, signed 2:45 p.m. and presented to the judge by the jury, said one juror didn't agree with the consensus.
"The note said that she said that "If have a reasonable doubt, I'm not voting guilty, I don't care if we stay here for a month," said Leeds.
The defense asked the judge to declare a mistrial because they felt the rest of the jury would bully that juror into voting guilty.
"He says no, I'm not declaring a mistrial. He sent it back for them to deliberate some more and then, within an hour, they came back and...guilty," said Leeds.
Barajas now faces up to forty years in prison.
"The verdict came back so fast, I don't think it was very properly considered. I think they couldn't get over the fact that there were two dead bodies," said Leeds.
