Defense Lawyers found guilty in contempt trial

EL PASO, Texas —

On the sixth day of a contempt of court trial for two El Paso defense attorneys, the judge returned a guilty verdict.

When it comes to their clients, guilty generally isn't a word the defense team of Theresa Caballero and Stuart Leeds likes to hear. But when it comes to themselves, it appears they're willing to make an exception.

Both were charged with numerous counts of contempt of court stemming from their courtroom behavior while successfully defending Judge Regina Arditti in a bribery case last year. The visiting judge, Judge Steve Smith filed the charges saying their conduct was the worst he'd ever seen.

"To me it's a badge of honor to be found in contempt by somebody like Judge Smith who is so abusive and to be able to say I threw myself under the bust instead of throwing my client under the bus," said Leeds.

Visiting Judge Juanita Vasquez-Gardner presided over the six day criminal contempt of court trial. On Saturday she found Leeds guilty on 5 out of 6 counts and Caballero guilty on 10 out of 11 counts. Vasquez-Gardner said the legal duo intentionally "impeded" an "obstructed" court.

Despite the ruling, Caballero, who began Saturday asking for a mistrial, said there were no hard feelings.

"We knew going into this, it would be just too hard for a judge to deny another judge," said Caballero.

Both attorneys celebrated outside the courtroom because the judge dramatically reduced their fines. Caballero saw her fines go from $5,000 to $900 and Leeds went from $2,700 to $500 but then Vasquez-Gardner probated them, so the attorney's won't pay a dime. They won't be serving any jail time either. Each count carried with it, the possibility of six months in jail.

"I don't have to go to jail, I don't have to pay any money" said Leeds.

"The winning point is she (Vasquez-Gardner), and she used the words, it would be a 'travesty' for us as lawyers to lose our licenses," said Caballero.

That's next on the docket. Both lawyers face separate grievance trials before the State Bar of Texas, where they could potentially lose their license. But both feel confident that won't happen.

"The grievance has never really weighed on my mind at all," said Leeds.

Throughout the proceedings the legal duo made several accusations and personal attacks on Judge Steve Smith. They accused him of being a racist for sending an e-mail before the Arditti trial began instructing the attorneys that court would begin at 8:30 a.m. and that El Paso lawyers might not be used to starting court at 8:30 am.
