Local woman claims tax preparer hasn't filed amendment, won't return original documents

EL PASO, Texas —

"We just want our belongings back. I mean, it's important information," said Pat Rodriguez.

Original paystubs, W-2's and her family's social security numbers are just a few things Rodriguez is missing.

Rodriguez said, "At the time that we went, she said don't worry because this is an amendment and you've already filed. So you wouldn't be in any trouble."

Rodriguez went to file an amendment to correct prior information in her tax filings. She entrusted Sandy Salinas, who runs a business from home, with the job.

"She's never called back, she's never returned our calls, she's never sent us our information. Nothing," said Pat Rodriguez.

It's been six months.

Rodriguez says she's tried everything, from phonecalls, to emails, even showing up at Salinas' home -- all with no luck. We tried to track Salinas down today. No answer. But we did hear from a neighbor who said she's spoken with several people trying to get in touch with Salinas about similar issues. But should you find yourself in a situation like this one, who is responsible?

"Well, by law, we're not allowed to keep anybody's paperwork. We can't hold somebody's paperwork hostage," said Richard Mier, of Expert Tax Solutions.

That said, there isn't a whole lot Rodriguez can do, at least not right away. Rodriguez says she's been told by police this is a civil matter and she'd have to file a lawsuit. She says that's her next step.

Rodriguez added, "I'm angry that I have to go to this extreme. I've never wanted to cause any problems for anyone I just want what's rightfully mine and my family's."
