Judge names Flora Bernal executor of Sherman Hemsley's will

EL PASO, Texas —

The body of a famed television actor may finally have a resting place after Judge Patricia Chew announced Flora Bernal as executor of his will and rights to his remains.

Sherman Hemsley, best known for his performance on "The Jeffersons," died July 24 of lung cancer. Since then, his will and remains have been contested by his half-brother, Richard Thornton, and long-time business partner and friend, Flora Bernal.

Thornton proved to be Hemsley's brother after a DNA test, and he was fighting for rights to Hemsley's will for months. Since the battle began, Hemsley's body has been stored at San Jose Funeral Home in east El Paso.

Hemsley's will left his entire estate to Bernal, whom he lived with for 20 years.

Bernal has claimed that she was instructed by Hemsley to prepare his will.

Julian Horwitz, the attorney who prepared the will testified that he had no contact to Hemsley prior to June 13 -- the day he signed his will at the hospital.

"Those were the instructions Sherman addressed to me. He said, 'Go ahead and do it.' And that's the way I always did business," Bernal said. "I always did what Sherman wanted me to do. That's the relationship Sherman and I had."

On Thursday, Horwitz told the courtroom that he never had any concerns about Hemsley's mental capacity or demeanor while he went over his will with him.

"At no point in time did I feel he lacked capacity," said Julian Horwitz.

After being granted the rights to Hemsley's remains. Bernal said he will be buried at Fort Bliss.
