Judge grants temporary injunction for troubled daycare to pay employees

Board members of a troubled south-central day carewere in court Wednesday.

The Houchen Center in September couldn't pay its employees due to the day care's bank account being frozen.

The accounts were frozen as a result of a broad restraining order, after a group of board members closed and opened new accounts without notifying the board's president.

The dispute among board members left employees without a paycheck in September due to the frozen accounts.

"My hope is that we can all put this behind us and move forward as a board. The whole point behind this is to make sure that actions taken by the minority of the board members were not legal and granted without any authority," said Alexander Neill, attorney for the board's president Cheryl Felder.

The judge granted a temporary injunction on Wednesday that grants Houchen's board president access to accounts to pay employees and run the daycare.

This hearing lasted four hours with several witnesses being called.

The board members denied any wrongdoing.

New accusations were raised among the board of 14 members.

According to some members, seven months of documents are missing -- allegedly stolen from the center when it was briefly closed.

Those documents are food records needed for an audit.

The board's president Cheryl Felder said she is relieved to start getting back on track.

The board members said they also want things to be straightened out.

"Now that we've addressed the issues we can allow accounts to be unfrozen and pay staff,which was our main goal today," Neill said.

"This is something very troubling. There are some records that are missing brought up in testimony, needed for the audit by the department of agriculture," said attorney Richard Roman, who is representing the defendants.

The injunction does not allow board members to have access to remove property from the center or have access to its funds.

Felder's attorney is still looking to file a declarative judgment.
