Garcia-Mata Trial Ends In Mistrial

EL PASO, Texas —

A mistrial has been declared in the case against the man charged with taking the life of a woman back in 2008.

Jose Garcia-Mata, 22, was accused of killing Ana Elva Morales, 21, while allegedly street racing on Socorro Road on July 22, 2008.

After days of trial and hours of deliberation, the jury could not reach a verdict.

“Right now I'm happy because I'm going to be with my family still," said Garcia-Mata outside of court.

Garcia-Mata’s attorney Francisco Macias told KFOX the jury could not decide whether or not Garcia-Mata was actually racing in his Ford Focus. He said the jury was concerned that a data recorder inside the car was not analyzed to see if a rate of speed could be determined.

“It wasn't tested to see if they could some get information out of it as to what speed the car was going. And I think that was a critical and key factor," said Macias.

El Paso District Attorney Jaime Esparza said his office was ready to retry the case.

“We are prepared to take this case to a new jury on Oct. 8,” Esparza said in a statement.

Garcia-Mata, meanwhile, maintained his innocence.

“I really am sorry for this family that lost a family member but it was an accident," he said.
