Former Teacher On Trial For Alleged Criminal Sexual Contact

LAS CRUCES, N.M. —

A trial will resume Wednesday for a former Chaparral Middle School teacher.

Lance Weinbrenner, 41, was accused of molesting a teenager.

Judge Frank K. Wilson from Alamogordo was brought in to preside over this case since the judges recused themselves after having worked with the defendant's father, an attorney himself.

The jury will determine whether Weinbrenner is guilty of three counts of criminal sexual contact of a minor.

Emotional at times, the alleged victim's grandmother was the first to take the stand.

A translator speaking on her behalf said, "This is very difficult for me."

According to the prosecution, Weinbrenner would take the boy on trips with overnight stays as both a mentor and a Boy Scout leader. Their relationship started with the teen's interest in scouting because of his uncle was also a friend of Weinbrenner's according to the prosecution

“Because of the person I thought he was, I didn't think anything bad,” said the alleged victim’s grandmother, with the assistance of a translator.

After several trips, the grandmother said she began to question their relationship more, but the teen never alluded to any wrongdoing.

"Why are they going far alone,” said the translator for the grandmother. “It's nothing mama, it's nothing," the grandmother said, stating what the teen had told her.

The defense says it was the grandmother who had asked the then-teacher to move into their home to help get the boy back on track with school, but when he was disciplined, the teenager got upset. They claim he is using a story of molestation to get back at Weinbrenner.

The police were called in August 2006.

The prosecution says the teenager feared a gun that the teacher had in his car.

Only one witness was heard, but more are expected throughout the week.

Lisa Beairsto, the senior prosecutor for the District Attorney’s Office, said, “We started with testimony today from a family member of the victim and we're going to start up Wednesday morning with some more family members' testimonies, some school witnesses and the victim will testify as well. Weinbrenner resigned his position in Chaparral after being placed on leave."

If found guilty, Weinbrenner could face four and a half years in prison. The trial resumes Wednesday at 9 a.m.
