Firework stands open in Las Cruces to ring in the New Year

LAS CRUCES, NM —

Despite the drought in the borderland, fireworks stands in Dona Ana County are allowed to set up shop starting Wednesday through Jan 1.

Residents can bring in the New Year with a bang but not all fireworks are legal to use.

Jess Williams, spokesman of Dona Ana County, tells KFOX14, "We see them opening up in advance of July 4th and in advance of New Year. It happens every year and of course in Mesilla and in Anthony we have places where they're allowed to sell more than what's allowed in most of Dona Ana County."

Seasonal vendors have to apply for a business license; they're prohibited from selling certain types of fireworks and are inspected before they can open up shop.

However two businesses are open year round in Mesilla and Anthony that don't have any restrictions. One of them is Diablo Fireworks.

"Laws here are full line we can sell everything from artillery shells, firecrackers, fountains, M-5000 and M80s. You name it, we got it," said Oscar Garcia Manager of Diablo Fireworks.

Williams said although these fireworks are considered illegal in a majority of the county, there are some areas where they are allowed.

"They're only in very restricted areas where you can use the full menu. We advise people to use only the safe and sane fireworks in any unincorporated areas of the county; the city of Las Cruces, Hatch and Sunland Park," he said.

Garcia said most who step in to the shop to buy these types of fireworks are from out of town.

"They come through on I10 going to California and Arizona. Most of our customers are tourist passing by on I10," he said.

The store also encourages saftey and doesn't sell to anyone under the age of 16.

"There's a misconception that fireworks start fires but that's not the case. The misuse of fireworks that's when it can get out of control and start a fire. That's why people need to make sure that you do use them properly," said Garcia.

But Williams said those who live in the area need to be cautious when purchasing fireworks or they can end up paying a hefty price.

Those caught using illegal fireworks can face a fine of more than $2,000 or even jail time

County officials warn residents not to buy or use any aerial fireworks, firecrackers or roman candles.

Other fireworks considered illegal in the city include shells, chasers, multiple tube devices and mines.

Fireworks that can be bought within the city limits include: cone fountains, crackling devices, cylindrical fountains, sparklers, ground spinners, illuminating torches, wheels and novelty items.

Also keep in mind fireworks remain banned in El Paso and El Paso County.
