Fines Start For Hands-Free Law Midnight Saturday

EL PASO, Texas —

Starting midnight Saturday, police will begin handing out citations for drivers caught texting or talking without a hands-free device while driving.

After a month of handing out warnings, a fine of $114.10 will be handed out for breaking the new El Paso city ordinance.

Police officials said that simply touching a cell phone while driving will be considered a violation.

"It depends on how obvious the people are with the violation. I mean the easy one is going to be the person driving down the street holding the phone to their ear. The more difficult ones are going to be the texting in your lap," said Detective Mike Baranyay with El Paso police.

The law does not apply if drivers are making a call to 911 for an emergency situation and officers will use their discretion when issuing citations, police officials said.
