Family questions if Socorro Police conducted a full investigation after her brother died in a crash

SOCORRO, Texas —

The Socorro Police Department is under fire. The sister of a man killed in a crash a year ago has made claims its investigation was not thorough.

"It seems like it was yesterday," said Clarissa Portillo.

It was the evening of Sept. 26, 2011, that Miguel Portillo was killed in a crash in Socorro.

"I knew that they had been at Buffalo Wild Wings watching a Cowboys game," said Portillo.

She said her brother and his friend Tommy Cruz borrowed a friend's truck and headed back home to Fabens.

As KFOX 14 reported, Socorro police said the men were racing another car, lost control and rolled several times. Both men were thrown from the truck, but it was Portillo who died while being transported to the hospital.

"It was an extensive and an exhausting investigation," said city of Socorro spokesman Dave Garcia.

At this point Garcia said the case has been closed as unsolved.

"I want to know who was really the driver," said Portillo.

That's because Garcia said, "both victims were apparently intoxicated."

That means if Cruz was the driver, he could be charged in Portillo's death, but Garcia said Cruz claims he was the passenger.

"If he was the driver, for me, I want him to be convicted," said Portillo.

Garcia maintains that both men were out of the truck by the time any witnesses arrived to the scene of the crash.

"The injuries to the body and to the survivor are consistent with the passenger is the survivor," said Garcia.

An autopsy conducted on Portillo states whether he was the passenger or driver could not be determined.

"There are only two people who knew what happened," said Clarissa.

Clarissa said she is hoping police will re-open the case and pinpoint who was behind the wheel so she can have closure.

"He was a very happy person, he was a vocalist, and we do miss him a lot," she said.
