Las Cruces City Council votes in favor of proposed strip club

LAS CRUCES, N.M. —

The city of Las Cruces has granted a special permit for a proposed strip club that has many members of the community up in arms.

The permit was granted on a 6-1 vote Monday, which overturned the Las Cruces Planning and Zoning Commission vote denying the permit in September.

However, a motion to grant a liquor license failed and will need to go to the state.

It was not as large of a turn out at Monday's meeting compared to the last meeting for the proposed strip club.

Karen Wootton, the attorney for the strip club applicants, told City Council that the Las Cruces Planning and Zoning Commission failed to follow constitutional law.

As KFOX14 previously reported, the Las Cruces Planning and Zoning Commission voted against the permit 3-1 in September.

Wootton said the commission did not hear any evidence that suggested the applicants failed to meet legal requirements.

"Adult entertainment has been held to be protected expressive content," Wootton said.

A spokesperson for the applicants told KFOX14 in September that the proposed strip club, called The Bronx, meets all of the legal guidelines and that it will be a minimum of 1,000 feet away from any schools, day care centers, public parks and churches.

Wootton's words toward council members were fierce as she said she believed "this project will go forward one way or another" and that it was "a matter of whether taxpayers will fund the fight."

During the public comment period, citizens in attendance were not allowed to discuss the strip club.

However, once the council voted in favor of the permit, residents expressed their opinions.

One resident urged the council to not "pervert the constitution."

Another man said, "When you take young women who have no skills and the only way they do it is to exploit their bodies, that's gasoline and a match."

KFOX14 spoke with Steve Duran, who lives less than a mile away from Moongate Drive, where The Bronx strip club will sit.

Duran said he worries about the example it will set for his two daughters, ages 11 and 19.

"In our town, I'm totally against it," Duran said. "It's not very moral, in my opinion. It's a waste of money."

Wootton said her clients may choose to appeal some of the conditions at a permit hearing, but that hasn't been decided yet.
