Campaign contributions show possible conflict of interest in Sunland Park corruption cases

LAS CRUCES, N.M. —

A history of campaign contributions between the attorneys, judges and a defendant in the Sunland Park cases is calling the objectivity of those involved into question.

There are more than 20 defendants in the cases who face charges ranging from voter fraud to extortion stemming from last year's corruption bust.

According to the New Mexico Secretary of State Office's website, Dona Ana County District Attorney Mark D'Antonio, who is planned to act as the lead prosecutor, received almost $3,000 from a lot of the main players in those cases.

One of the presiding judges, Marci Beyer, gave D'Antonio a total of $805 for his campaign.

One of the defendants, Annette Morales, gave D'Antonio $180. Morales is facing charges of embezzlement.

Six of the defense attorneys gave D'Anronio a combined $1,910.

One defense attorney also gave $50 to Beyer for her campaign.

Another judge, Darren Kugler, received $50 from one defense attorney.

During a status hearing Monday, Beyer told the courtroom that she knows some of the people involved in the Sunland Park cases and offered to step down.

"If any counsel feels uncomfortable with me on the case, I'm willing to recuse myself," Beyer said.

But attorneys on both sides said they had no objections.

KFOX14 asked D'Antonio whether he felt his office has a conflict of interest in the cases, and he said for now, he doesn't believe so, but he still needs to investigate further.

"I'll have to look at that," D'Antonio said. "I haven't really examined every aspect of the case, so clearly if that's the case, if there are attorneys that have contributed to my campaign that are actively defending one of the defendants, I'll have to withdraw from the case. That's something that's really important; being transparent in prosecution and alleviating even a hint of bias."

If D'Antonio does step down from the cases, they can either go to a special prosecutor or be tried in another jurisdiction.
