KFOX has just learned from Texas State Senator Eliot Shapleigh's office that administrative law Judge William Newchurch has recommended denial of ASARCO's request to renew it's air quality permit. That renewal would be necessary for ASARCO to begin operating its Westside smelter.
The judge's decision is not the final step. His recommendation goes before the Texas Commission on Environmental Quality, which will make the final ruling.
