El Paso man to serve 8-16 years in prison

Jury reaches verdict in Miguel Vargas trial

EL PASO, Texas —

Miguel Vargas, who was found guilty of two counts of intoxicated manslaughter and two counts of intoxicated assault, showed no emotion Friday night as the jury read its verdict. 

On the two counts of intoxicated manslaughter, Vargas will get eight years of prison time each. On Tuesday, a judge will decide if those sentences will be stacked or run concurrently. 

On the two counts of intoxicated assault, Vargas will get 10 years of incarceration each. The jury decided to suspend those sentences so Vargas will serve them as probation. 

Vargas has already served nine months. 

Vargas's mother, Patricia Miranda, spoke with KFOX after the sentencing. 

"I thought they were going to give him more years but the sentence he got was fair in my eyes," Miranda said. "I'm hoping that he only serves eight years." 

Miranda said she anticipates that her son will serve eight years instead of 16. She said she empathizes with the victims' families. 

"I feel very sorry for the family," Miranda said. "As a mother myself, I can't understand what it's like to lose a family member." 

Vargas has been on trial since Monday, and the emotional courtroom has heard testimonies from the surviving crash victims and police officers who said Vargas has had a criminal history. 

El Paso police said Vargas, 23, was drunk and speeding with four of his friends in the vehicle when he lost control, crashing through a rock wall and down an embankment. The car and part of a building caught on fire. 

Vargas, Nefi Armendariz and Stacy Reyes survived, while Idaly Reyes and Kim Araujo, friends of Vargas, died in the crash. 

The courtroom was not as packed Friday as it has been over the last few days. In Thursday's court session, the judge warned all families involved to stop yelling and fighting, and his words echoed Friday as there was only silence in the courtroom. 

Vargas took the stand and asked that the jury give him probation, but Assistant District Attorney Christopher Miller asked him if the lives of the two women were worth probation. 

"No, they're worth more," Vargas answered, but later contended that he should still receive a lenient punishment. 

Vargas told the jury he has learned his lesson to never drink again. 

"I learned to value my friends and my family," he said. 

He was in jail for the last nine months and has been doing artwork, Vargas said. A painting he made of his 5-year-old was shown to the jury. 

Vargas said everyone in the car the night of the accident knew he had been drinking and made the decision to get in the car anyway. 

"Everyone makes bad decisions," Vargas said.
