EL PASO, Texas —

El Paso police traffic investigators say the pedestrian that was struck on Doniphan Drive Monday night was at fault. 

Around 7:45 p.m. police responded to a pedestrian accident on in the upper valley near Redd Road. 

Armando Aguilar, 55, ran across Doniphan Drive at the same time Maria Gonzalez, 45, was driving a Toyota Camry southbound, said police. 

They said Aguilar did not cross at a crosswalk and didn't yield the right of way to Gonzales, resulting in serious leg and head injuries. 

Aguilar was taken to University Medical Center. 

Police said they suspect that Aguilar was under the influence of alcohol. 

Gonzalez and her passenger were wearing seat belts and were not injured in the accident.
