Update: Operation Linebacker Lawsuit Settled

El Paso County Sheriff Leo Samaniego is reviewing the training policy for peace officers in light of an out-of-court settlement made between the county and local activist Carl Starr.

The lawsuit, filed on May 26, alleged a violation of Starr's civil rights arising from a sheriff's traffic stop as part of Operation Linebacker on a bus that was traveling on I-10 near Fabens.

On Monday, El Paso County Attorney Jose Rodriguez announced that Commissioner's Court approved the settlement in order to dismiss the civil lawsuit.

Many residents had told KFOX they were concerned, because they said deputies were stopping drivers and asking them for proof of citizenship.

Samaniego stated, "To protect the integrity of our office, I will commit to a more clear written understanding of our mission to fairly and impartially enforce all laws including the trafficking of persons."

Jo Ann Bernal with the El Paso County Attorney's office said, "The settlement was for a couple of reasons. One, the commissioners thought it was important for the community to settle this controversial issue. Two, it was important to not spend any more money on litigation regarding this issue... Particularly in light of the fact that the sheriff had changed the policy, and essentially did what the lawsuit set out to do."
