Texas Lawmaker Wants Repeat DWI Offenders To Lose License

A proposed law may come as sobering news to people who get convicted for driving while intoxicated more than once.

A Texas legislator wants to change the state law so that people who get convicted of DWI twice will permanently lose their driver’s licenses.

Sen. Jane Nelson, R-Flower Mound, said she was prompted by an Easter-morning accident in which a man with three DWI convictions was involved in a car crash that killed an Argyle mother and daughter.

John Patrick Barton is suspected of drunken driving. Because of his DWI history he has been indicted on murder charges in the deaths of Kandace Hull, 33, and Autumn Caudle, 13.

Currently, Texas provides only that licenses can be suspended for a maximum of two years.

"Clearly the penalties are not severe enough to change behavior," Nelson said.

She said prosecutors have told her they are seeing more cases in which people convicted of multiple DWIs end up killing someone.

The senator said she intends that her bill also make drunken drivers who cause serious injuries subject to a first-degree felony, which carries a sentence of five to 99 years and a fine of up to $10,000. Current law provides a sentence of up to 10 years.
