Former Sunland Park Judge Candidate On Trial

He won an election to become Sunland Park Municipal Judge, but shortly after winning, he was accused of voting fraud. Horacio Favela was in court Monday for his own trial.

Opening statements were expected to begin Tuesday morning.

Favela has been accused of fraudulently registering as a candidate for municipal judge in Sunland Park and of fraudulently voting.

Favela allegedly declared he was a Sunland park resident so he could gain the candidacy needed but allegedly actually lived in El Paso.

Prosecutors also said he voted twice in the November 2004 election--in both Texas and New Mexico.

Because of that, Favela has been indicted on numerous counts, including two counts of falsely swearing in a municipal election, three counts of falsifying election documents and one count of either false voting for not being a qualified elector or false voting twice in the same election.

Each charge is a fourth-degree felony and if convicted each count could include a sentence of up to 18 months in prison and a $5,000 fine.

Most of Monday was taken up with selecting a jury for the trial.
