Constable Shoots Man In Hip

A 32-year-old east El Paso man was shot in his hip by an off-duty constable early Saturday morning, El Paso County sheriff’s deputies said.

Deputies got the call that shots had been fired and a man was down near Lee Trevino and Pellicano at 2 a.m.

Sheriff’s officials said two constables were working security at Bandoleros night club when they heard an apparent gunshot sound coming from a nearby parking lot.

"They went to check it out," said Sheriff's Deputy Jesse Tovar. "They saw an individual hiding in between the vehicles."

Tovar said the constables identified themselves, and the man started to run. They caught up with him near Pellicano.

"They told him to, you know, let me see your hands," said Tovar. "At which point the individual made vertical movements to his waistband."

One of the constables drew his gun in response and fired, striking the man in his hip. He was transported to University Medical Center with non-life threatening injuries.

"The constables did have a right," said Tovar. "They do have peace officer powers. They did confront the individual. They identified themselves. They asked him to put up their hands. So at this point, right now, it seems that the constables did do a good job."

Officials have not released the name of the constable involved because of the "sensitivity and delicacy" of this situation. The sheriff's office is investigating the incident including the possible gun shot before the chase.

"We haven't found anything yet," said Tovar. "We're still investigating whether, in fact, it was a shot fired."

Tovar said, regardless, the man did try to evade a constable, and when an officer feels that there is a threat, he is trained to engage.

"He was making vertical movements," said Tovar. "They didn't know. It was dark. They didn't know what this individual was going for. They had already instructed him to put up his hands. He refused to obey their verbal commands. So at that point, it escalates."

Officials would not reveal if the man had a weapon on him. He faces pending evading charges.
