CHAPARRAL, N.M. -- A Chaparral man said his driveway of 23 years was fine until a company dug it up to install a sewer connection. When it rained last Friday, his vehicle sunk inches into the ground.

Wendel Ake said it hadn't rained at his home in months, and he had no way of knowing mud would be a problem because of the work that was done.

”I have a mud-bogging track in my driveway,” Ake said.

Rains about a week ago left Ake stuck in his driveway. He blames the problem on Granview Plumbing in Las Cruces, the company that installed a sewer line. He said a disability prevents him from being able to do anything about it.

“They didn't pack it down or anything. They didn't drive the tractor over the holes they dug," he said.

The owner of Grandview said it did the work months ago and it was inspected.

“I do have a permit. It was inspected by Dona Ana County,” Liz Montoya said.

The rain has since dried, but after Ake's Suburban sank inches into the ground, he called Grandview to see if could do anyhing about it.

“They didn't give me a definite answer. They said that their work was guaranteed for 30 days,” Ake said.

“We did this job for him in November. We completed it in November. Everything was fine. He signed a paper that he was 100 percent satisfied with the program,” Montoya said.

But Ake said he doesn't know about that paper, and didn't know the rain would be an issue.

“I didn't get any paperwork to sign or anything; they just told me over the phone when I called them,” Ake said.

Montoya said she fixed a dip in the road for him, replaced a ladder and responded to plumbing problems. She fears he is trying to take advantage of her company. He disagrees.

“If I was taking advantage of this company, I would have been on her many days ago,"Ake said.

Ake qualified for a grant to have the work done, so he didn't have to pay the $3,000 price tag.

He's inquiring about a lawsuit. Montoya said she has all the paperwork to back her company up.
