Insurance Agents Need To Follow New Rules Or Suffer Consequences

EL PASO, Texas -- On Nov. 15, open enrollment for Medicare Advantage insurance plans start. Some local leaders call it a feeding frenzy for dishonest insurance agents looking to take advantage of the elderly.But because of the stricter rules, agents and insurance companies will face the consequences. Unfortunately they already caused many families a lot of pain."They both couldn't access the doctor that they needed at that time or the hospitals they needed to get their care," said Rebecca Ramirez.It's a story that continues to repeat itself throughout El Paso: unscrupulous agents misguiding the elderly into switching insurance companies in order to get a commission. Hundreds of senior citizens lost their Medicare benefits and in some cases became dangerously ill. It happened in Ramirez's family."The whole family was distraught over it; it was devastating. We lost my dad shortly after that," said Ramirez.After a number of Medicare fraud cases in El Paso, agents and insurance companies have a new set of federal and state laws to follow and consequences to face if they're in violation.Insurance agent Isabel Fernandez Aguirre received a disciplinary action. KFOX obtained an official order that states Aguirre made misrepresentations concerning a Medicare Advantage product and caused an elderly woman to enroll in a program not accepted by her doctor. The complaint includes that her business card depicted the state of Texas seal, a violation if you don't obtain a license from the state.By the time Ramirez found out her dad was misled into changing his health care plan for himself, it was too late. But she's glad the rules are changing."The fact that they're being penalized by their action, it does bring some justice to the situation in targeting the elderly," said Ramirez.
