Trial Date Not Set For Councilwoman

It’s been more than a year since misdemeanor charges were filed against Councilwoman Rachel Quintana, and trial hasn’t been set.

The trial is on hold pending a ruling by the 8th Court of Appeals. Quintana’s attorney, Stephen Peters, filed a motion of denial of habeas corpus. The court is now waiting for Peters to file a brief which is due Monday. The presiding judge will be visiting Judge Steven Abel from Kerrville.

“Now, that I don’t understand why. Why can’t we take care of our own problems here? Why do we have to bring someone else? Is this just to further delay her court hearing, or what?” said Rosie Gardea, of east El Paso.

KFOX first broke the story last October when Quintana allegedly forged an employment letter from FedEx to get a discount on a Southwest airline ticket.

Quintana’s attorney has also asked for evidence to be quashed -- in other words, the evidence against Quintana be thrown out.

It's not uncommon for misdemeanor cases to take more than a year to go to trial. What is unusual in this case is the constant changing of attorneys. Quintana's had at least three represent her.

Quintana continues performing her duties as city representative of East El Paso while she's out on bond.

KFOX tried to get comments from Quintana and her attorney, but calls were not returned.
