Autopsy Results Released For Officer Involved Shooting

Newly released autopsy results are now raising questions about whether the officer involved in a deadly shooting acted appropriately.

Police said 48-year-old Gregory Smith had been stopped by Officer Matthew Jones on June 13, 2008, for an outstanding warrant. Smith allegedly began making threats and pulled what appeared to be a weapon from his pants. That weapon turned out to be a toy gun. Acting quickly, police said Jones drew his gun and fired 11 times. According to the autopsy, seven of those bullets landed in Smith's back -- a fact that now has Smith's sister crying foul.

"I just think the cop was trigger happy. I think he needs to be fired from the police department. That's not what a police officer does; they're to protect and serve," Becky Hughes said.

But El Paso Chief of Police Greg Allen disagreed, saying the autopsy is just one aspect of the investigation and that Jones was justified.

"The number of shots in this indication show that the officer felt that he was still under threat, and based on that he continued to fire the weapon until the threat was neutralized," Allen said.
