N.M. Domestic Partnership Bill Heads To Senate

House Bill 9 would give gay and heterosexual couples the same rights as those who are married.

The 33-31 vote allows for this bill to be examined by the senate, where it lost steam last year.

New Mexico residents have mixed emotions about the bill.

“I'm actually surprised to hear that was that close. I just think that a lot of who vote fall on the more conservative side,” said Las Cruces resident Jonathan Hernandez.

The domestic partnership bill makes it relatively simple for couples, whether they are gay or heterosexual.

They would only have to pay a $25 fee, and file an affidavit of domestic partnership.

Attorney Mannie Arrieta said, “When you do file the affidavit, you're conceding that the courts have jurisdiction. The laws of the state apply to you as if you were a married person.”

That means couples will then also be subject to divorce, paying child support and spousal support. But Arrieta said the biggest change will come at the workplace.

"The first impact is going to be on the employers, they're going to have to be ready to provide health insurance, family leave and other accommodations they currently provide to married people," said Arrieta.

And religion has also played a role in some Las Cruces residents’ decisions.

“I see marriage as the only relationship between people that should be acknowledged as a legal binding thing,” said Danny Cox of Las Cruces’ North Mesa.

The domestic relations part of the courts is the busiest, and Arrieta said if the bill passed, it could create a heavier workload.

We expect there to be an increase for six months after the bill passes and if it's signed.

If the bill does pass, New Mexico will be one of a dozen states that recognizes these partnerships. It will go before its first Senate committee Tuesday at 2 p.m.
