Posted: 9:32 pm MST November 24, 2006

An accident at the corner of Three Saints Street and O'Hara Road in Anthony, N.M., is the second accident in 24 hours in Anthony that involved speeding, not wearing a seat belt, and possibly alcohol.

New Mexico State Police say the accident took place around 4:45 a.m. Friday.

"As she got to the intersection, you could see the brake marks, where the vehicle was traveling at a high rate of speed around the intersection and struck a telephone pole," said Officer Diego Herrera with New Mexico State Police.

The car received serious damage, and the nine-year-old girl in the passenger seat had serious injuries.

"There was lots of blood around the vehicle, inside and outside the vehicle, their was heavy damage to the vehicle," said Herrera.

New Mexico State Police said the woman driving, 24-year old Ericka Pena, and her daughter somehow found a ride from the accident to memorial Medical Center, 24-miles away, in hopes of taking care of the nine-year-old girl.

"The little girl was in serious condition, and in that point had started throwing up blood, and losing consciousness, so they were flying her to Thomason hospital," said Herrera.

Officer Herrera also said the mother stayed behind and told hospital staff that the young girl's father had been driving, and dropped the girl off with her. But police took the mother back to the scene, and ended up placing her behind the wheel.

"The seat was pushed forward, it was with someone who was short, and she was about five foot four, so it was just consistent with the way of the vehicle and the accident," said Herrera.

They administered a breathalyzer test, which officers say she failed, and was placed under arrest.

This is the second accident in less then 24-hours that involved speed, people not wearing seat belts, and possibly alcohol. Only KFOX showed you how on Thanksgiving morning 21-year-old Damien Avelar was killed when he also crashed his car in Anthony.

The driver, Pena, is facing a number of charges including aggravated D.W.I., great bodily injury by a vehicle, child neglect, and leaving the scene of an accident. The nine-year-old girl is in stable condition at Thomason hospital, and told police that her mother was driving at the time of the accident.

Dona Ana County sheriff's deputies planned to set up a DWI checkpoint at an undisclosed location Friday night to be on the lookout for drunk drivers, along with drivers' licenses, registration and proof of insurance. It's all in hopes of curbing the recent rash of accidents.
